         When a person is granted early release from prison through the Parole process, there are a number of conditions that must be met for that person to remain out on parole. Such conditions are reporting at required times, drug testing If those conditions are not met, parole can be revoked and the person returned to prison. If you have been notified of a violation of parole, the process of parole revocation involves two steps: 
  1. Preliminary Hearing, which determines whether probable cause exists that a parole violation  occurred. If Probable Cause is found that a violation occurred, the matter is then set for a Revocation Hearing; 
  2. Revocation Hearing, which determines whether a preponderance of credible evidence exists to believe that one or more conditions of release have been violated. If probable cause is found, the Board will then make a determination of whether Parole will be revoked and the individual returned  to TDCJ, or remain on parole.

 

        The panel has several options once it has determined that a parole violation occurred: the offender may be continued on supervision with or without graduated sanctions; the offender may be incarcerated in an Intermediate Sanction Facility or transferred to a Substance Abuse Felony Punishment Facility for a limited period of time while remaining on supervision; or the offender’s parole or mandatory supervision may be revoked and the offender returned to prison.

 

        It is important that you protect your rights during the parole revocation process. Having an attorney gathering evidence which is presented to the Board and exonerates you, or in the alternative, explains the violation and mitigates the punishment is an essential part of the process. Parole conditions can be strict and violations can occur due to circumstances beyond your control.
